These General Terms and Conditions of Sale (GTC) govern the sale of products by For My Toddler on the website formytoddler.com. Any order implies unreserved acceptance of these GTC.

Article 1 - Purpose

These GTC aim to define the rights and obligations of the parties in connection with the online sale of baby and toddler products offered by For My Toddler.

Article 3 - Products

The products offered for sale are those listed on the website formytoddler.com. They are described and presented with the greatest possible accuracy.

The photographs and visuals presented on the website are not contractual. Although we strive to present faithful images, color variations may appear depending on your screen.

All our products comply with current French and European legislation, particularly regarding the safety of children's products.

Article 4 - Prices

The prices of our products are indicated in euros (€) all taxes included (TTC), including the VAT applicable on the day of the order.

For My Toddler reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the buyer.

The indicated prices do not include delivery costs, which are billed additionally and indicated before the final validation of the order.

In accordance with the European Pricing Directive, in the event of a price reduction, we display the lowest price practiced during the 30 days preceding the reduction.

Article 5 - Order

5.1 Order Process

To place an order, the customer must:

  • Select the desired products and add them to the cart
  • Check the contents of the cart and quantities
  • Enter their delivery and billing details
  • Choose the delivery method
  • Choose the payment method
  • Accept these GTC by checking the corresponding box
  • Confirm the order and proceed to payment

5.2 Order Confirmation

The sale will only be considered final after For My Toddler sends the customer an email confirming acceptance of the order and after full payment has been received.

5.3 Product Availability

Our product offers are valid within the limits of available stock. In case of unavailability of a product after the order has been placed, the customer will be informed as soon as possible. The cancellation of the order for this product and its refund will then be made, the rest of the order remaining firm and final.

Article 6 - Payment

6.1 Payment Methods

Payment is made online securely by:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Shop Pay
  • [Other accepted payment methods]

6.2 Payment Security

Online payments are secured by our payment provider Shopify Payments. Payment data is encrypted and is never stored on our servers.

6.3 Invoicing

An invoice is established and made available to the customer in their customer area and/or sent by email upon shipment of the order.

Article 7 - Delivery

7.1 Delivery Area

We deliver in mainland France and in European Union countries.

7.2 Delivery Times

Delivery times are indicated on the product page and when validating the order. They are given as an indication and run from the validation of the order and payment.

Average delivery times are:

  • Mainland France: 7 to 15 working days
  • European Union: 10 to 18 working days

7.3 Delivery Costs

Delivery costs are calculated based on weight, volume, and destination. They are indicated before the final validation of the order.

7.4 Receipt of Order

It is the customer's responsibility to check the condition of the package upon receipt. In case of apparent damage, the customer must refuse the package or make written reservations on the delivery note and contact us within 48 hours.

Article 8 - Right of Withdrawal

In accordance with article L221-18 of the Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal under certain conditions.

8.1 Exercise Modalities

To exercise this right, the customer must notify us of their decision to withdraw by:

8.2 Return of Products

Products must be returned in their original condition, complete (packaging, accessories, instructions) allowing their marketing, within 14 days following notification of withdrawal.

Return costs are borne by the customer, except in case of a defective product or an error on our part.

8.3 Refund

The refund will be made within 30 days from the receipt of the returned product or proof of shipment of the return. The refund will be made by the same payment method used for the order.

8.4 Exceptions

The right of withdrawal cannot be exercised for products unsealed for reasons of hygiene or health protection (in accordance with article L221-28 of the Consumer Code).

Article 9 - Guarantees

9.1 Legal Guarantee of Conformity

All our products benefit from the legal guarantee of conformity (articles L217-4 to L217-14 of the Consumer Code) and the guarantee against hidden defects (articles 1641 to 1648 and 2232 of the Civil Code).

In case of non-conformity, the customer can obtain the replacement or repair of the product, or failing that, a reduction in price or termination of the contract.

9.2 Commercial Guarantee

Some products may benefit from a manufacturer's commercial guarantee. The conditions are specified on the product sheet or in the documentation provided.

Article 10 - Liability

For My Toddler cannot be held responsible for the non-performance of the contract in case of:

  • Force majeure
  • Unforeseeable and insurmountable act of a third party
  • Customer fault (incorrect address, absence during delivery, etc.)

The photographs and graphics presented on the website are not contractual and cannot engage the responsibility of For My Toddler.

Article 11 - Intellectual Property

All elements of the formytoddler.com website are and remain the exclusive intellectual property of For My Toddler. Any reproduction, exploitation, or dissemination, even partial, is prohibited without prior written authorization.

Article 12 - Personal Data

Personal data collected is necessary for order processing and customer relationship management. It is subject to computer processing in accordance with the GDPR.

Article 13 - Mediation

In accordance with article L.612-1 of the Consumer Code, the customer has the right to free recourse to a consumer mediator for the amicable resolution of a dispute.

Article 14 - Applicable Law and Jurisdiction

These GTC are subject to French law. In case of dispute, an amicable solution will be sought before any legal action.

Failing an amicable agreement, the dispute will be brought before the competent courts in accordance with the rules of common law.

Article 15 - Modification of GTC

For My Toddler reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.

Excerpts from the Consumer Code

Article L217-4 of the Consumer Code:

"The seller delivers goods in conformity with the contract and is liable for any conformity defects existing at the time of delivery. The seller is also liable for conformity defects resulting from the packaging, assembly instructions or installation when the latter was carried out under the seller's responsibility or was specified in the contract."

Article L217-5 of the Consumer Code:

"The goods are in conformity with the contract: 1° If they are fit for the use ordinarily expected of similar goods and, where applicable [...]"

Article L217-12 of the Consumer Code:

"The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods."

Article 1641 of the Civil Code:

"The seller is bound by the warranty against hidden defects in the sold item that render it unfit for its intended use, or that so diminish this use that the buyer would not have acquired it, or would have given a lower price for it, had they known of them."
